He provides consumers case law to keep them apprised of court decisions against agencies as well, but he does so to assist the consumers with guidance on how to maximize their efforts to extort money from collection agencies and avoid payment of the underlying debt.

Pcmholdings

UPDATE we put another message board out of business that help consumers defraud creditors.

The entire PCM Holdings.com website is for sale. That includes the forum, debt buying/selling pages, collection pages, the whole thing... The entire site is for sale for 15K or to the highest bidder. The site also has 600 registered emails which would be useful for sending newsletters and email campaigns. This could be a huge opportunity for somebody.

The website is located at www.PCMHoldings.com. The new buyer would just have to change the content on the various collection pages to suit their own particular business model, and then it's ready to go. Or maybe somebody would like to own it for a second website if they already own one?

Feel free to email me at AlbertAFT@aol.com or call 714.965.5950.

Verizon question
Four years ago verizon canceled my land line for non-payment.

I never paid them.

The debt does NOT appear on my credit reports.

How should I procede?

Ignore it?
Somehow get in touch with Verizon and see if I can pay it?

I'm wondering if it's going to come back and haunt me someday.

Any thoughts?

The "grandaddy" ID was banned, just as this new one was, and most likely he'll be back under a different name.

(s)he should know that no one here does anything illegal. We become educated consumers, we help each other become educated, we use the rules that are already in place.

Interesting that there are so many posts here about how people paid their accounts, how some paid only to find the account was not theirs, how CA's have broken rules, and how people who are honest and good come here to get information on how to go about getting on the right credit path. Interesting that (s)he interprets all of that as some kind of underhanded thing.

Maybe that person needs to re-read with a different point of view. Is that person so perfect that (s)he never fell into a bad credit situation? Even if the blogger has been perfect, it's not accurate to judge others as bad people due to whatever circumstance got them in a bit of a bind.

Maybe what (s)he doesn't like it that consumers are getting educated and now the CA's are not the ones playing the credit game. CA's had a lot of power when they were the only ones who knew the game. And BTW, this forum is available to anyone. Anyone can view it and never register, even CA's, and I'm sure they do since credit is their business, so they don't need your help to know what is posted here. You've not done anything but waste your time and energy and feed a negative feeling that will eat away at a person like a cancer.

Take a deep breath, blogger, and realize that no one is trying to escape paying bills. The exact opposite is true. We are gaining information on how to manage our own credit files in the best way to be able to manage our money, our bills, and how to defend ourselves against CA's who sometimes (often) break rules. Mistakes happen from creditors and it is our right to do something about that. You have no right to infringe on our rights - they are your rights too, as a consumer. You and everyone should support the rights we all have.

No one here is breaking the rules; we are learning them and learning how to use them. How is that bad? It's not, so take a deep breath and re-think. You have let this get you so bothered that you blog, contact creditors, and make comments here. That anger is not healthy. And unnecessary. Maybe someone just needed to give you a different perspective about what this is about. I hope these posts helped, truely.

Old CC debt?
I have a credit card that went into default about 5yrs ago now. We are trying to qualify for a new home and they want me to show that this has been taken care of, no matter if I settle or pay in full.

A) What is the best way to try and settle this in terms of dollar amount. The original card had a limit of $2500, the credit report now shows like $6600 with all their crap interest they try and charge.

B) What should my demand be on how they report this to the credit reports and how will this affect my credit score as it has come back up to a nice range of about 700 and I don't want this to affect it in a bad way.

Thanks for any advice you can give!!

Sent DV letter and this is what I got?
I sent a DV to a CA just a week ago so imagine my surprise when a 1 1/2 inch envelope arrived in the mail from them today. This debt was for an old cell phone. What they sent me was a bill on their letterhead along with the name of the original cell company. They also sent me copies of 4 months of my phone bill. It states they are requesting a response in 10 days. No where on here does it state they have the right to be collecting this debt. As far as I know, they found copies of my bills in some dumpster. So, what now? Isn't the purpose of a DV to prove they have a right to be collecting on this debt?

Default What do I do with a Aggressive Collection Agency
I was contacted mid July about a CC account by a collection agency that is very aggressive. This agency has several complaints against them for extreme collection methods. They called me before I even received a letter stating they had the account and demanded payment in full within 24 hours. They stated that they were collecting asset information to recommend a law suit, including liens against my property. When I informed them that there was no way to pay the amount in full but I would be willing to work out some payment arrangement they said no arrangements would be made. They also said that if I did not pay in 24 hours the debt would escalate from $3000 to over $7000.

Can they place a lien against my home? Can they refuse any attempts to make reasonable repayment on the debt? Please help - very scared!
Thanks,
austin

Will a comany take you to court if you owe under $1,000 to them? I just wanted to know the average amount before they do. Does it matter more on if it is a credit card, phone company, cell phone company or other? I know each company is different.

It is virtually impossible these days to hide in this manner. Everything you do, from ordering a pizza delivery, having a phone or cell phone, having utilities turned on, having a job, or having any credit at all leaves a trail.

Quote:
each time the debt is sold, you gain a new negative account on your files.
I'm sorry, but that just isn't correct. Once a collection agency sells the debt to another CA or junk debt buyer, they have to remove themselves from your credit reports. They are no longer the owners of the debt, they no longer have any permissable purpose to even look at your files. There should only ever be at most 2 entries for a single debt on your credit file - the ORIGINAL creditor, and the CURRENT collection agency. Since a collection cannot outlive the obsolescence of the ORIGINAL debt, when the original debt drops off your credit reports after 7-1/2 years, so must ALL collections. If a collection is still on your reports but the original is not, then the collector has illegally re-aged the debt to keep it on your reports and you can dispute it off as obsolete.

You MIGHT be able to lay low long enough for the Statute of Limitations (SOL) in your state to expire. While the expired SOL is NOT a bar to being sued (except in CA and WI), it is an absolute affirmative defense if you are sued to get the case thrown out of court. SOL's vary by state. Some are as long as 15 years (OH), and others are as short as 3 (SC, NC, NH and a few others).

Whether or not you get sued depends on many factors - who the creditor/collection agency is - some are more aggressive than others; the amount you owe - larger amounts are more likely to wind up in a lawsuit; assets you have - if you have a home you are a prime target. If you have a job they know they can get your wages (except in TX, PA, NC & SC). If you have no job and no assets, they may never sue.

Sooo.. there are a lot of factors to consider if you decide to try to dodge.

5 year old debt turned into a collection TODAY and it is haunting me!!
Today, I really feel like a loser. I have done a really good job of establishing new credit and cleaning up past bad credit, but today I was delt a big blow. I get a "credit alert" from truecredit telling me that I have a "Major Derrogitory" that just showed up. I utilize multiple caller id blocking tools and call recording tools that I hava at my disposal, and call the colection agency to see what this is all about. They inform me that it is for Long-Distance service on a home phone line that I had about 5 years ago and that I owe $350 on the account. The name of the company rings a bell, but I can not 100% gurantee that this is a legit debt.

After mutiple calls to the CA today, I got a hold of a girl that I thought would be helpful. She was nice and kept letting me know her supervisor was still on the phone and would be with me shortly. She connected me with the supervisor when she became available, but the supervisor refused to delete my collections from the big 3 and basically told me that I was screwed, even if I paid the debt in full. I offered to pay the $350 in full if they would delete the info, but they told me they do not do that. They "don't delete accurate information", although I never said the info was accurate.

I then called the OC. I entered my previous phone number for the CA account and was offered the option of paying the $350 outstanding balance. This was strange to me. If the account was turned over to a Collection Agency, why would they allow me to pay on the account?

I begged and pleaded, but I was not allowed to talk to a supervisor. The rep just told me that "it's against our policy to delete accurate information", even though I never said the info was accurrate.

I was thinking about the following....

1) Pay the account and then send the original creditor a variation of the "Litigious Nutcase" letter and wait.
2) Pay the debt with a friend's credit card and admit nothing. Sure, somebody paid the debt, but it was NOT ME!
3) Do some type of Debt Validation and hope for the best. I don't know much about DV, so please give me some ifo if you have it!!

When a CA keeps pulling my credit report?
Is there anyway that I can get a CA to stop pulling my credit report. I was looking at my credit report last night and was amazed at the different companies that have pulled my report. Its frustrating to see that any company can pull my report without my knowledge but when I try to pull my own, it takes an act of Congress! I had no idea a CA could do this until one called me and said "according to your credit report you are paying your other bills so you must have some type of income.

Being Harrased by CHASE - how do I stop it?
They keep calling me - I counted SIX calls in one night from the same number. I have told them repeatedly not to call me at home, and my payments are NOT really late. I have already contacted the main office and let them know that my payment due date conflicts with when my husband gets paid - the check goes out automatically by on-line payment and ends up being 5 days late because of the conflict between our paycheck date and the payment due date fall on the same day. I have contacted them and asked to have our due date changed and was told that it was and was also told I should not be receiving any more phone calls. I got 3 tonight! I am tired of being harassed over a payment that is only late by 5 days! What can I do to get this to stop? This is ridiculous!!!

So what are my options now?
A little background...

I was out of work for a while. Working now for a while and finally able to take control of my credit. (Slowly).

I had a ton of CC Debt. Here is where things stand now.

MBNA, payment arrangement for last nine months, just dropped my interest down to 11% and reported me as current.

Discover payment arrangement for last nine months, Interest rate down to 15.99% (from 22%) and reporting as current for six months.

3 others placed with CA. ASG, P. Scott Lowery and Global Vantedge.

I missed the 30 day win for the first two, but all three received validation letters in the last month.

Here are the questions.

1. If I pay in full how can I assure that the collection gets removed from the CRA and how can I get the OC to remove the outstanding charge off balances?

2. If I deal directly with the OC to pay them how do I get rid of the CA? Amex/Global is a assigned debt. If I get AMEX to get a payment plan going how to I get the CA to leave me alone?

I sent the DV letter the day after I received the first contact letter from them. They had started calling about a week before I received ANY paperwork from them, so I had already written the DV letter and was just waiting for written communication from them so I could get their mailing address, etc. They are the second CA assigned to this account. Yes, the account is mine, but I have no intention of paying a CA. I will deal with the OC as soon as I have the money to settle with them.

But even if I would settle with the CA instead, it is my impression that I shouldn't pay them a dime prior to proper validation anyway.

I mentioned to this wonderful "lady" that I had sent them a DV letter and had requested no contact by phone. She said something like "We never received a letter" and I replied that I had sent it CMRRR and had received the green card back w/ a signature last week. She asked "So are you saying you never had a mobile phone?" (This acct. was originally w/ Cingular Wireless). I didn't answer her. If I would acknowledge that it is in fact mine would that negate their requirements to provide me with validation? I wasn't going to admit any liability over the phone with these people. As I said here, yes it's mine but I'm not dealing w/ a CA if I can avoid it.

She then said that I cant' tell her what to do, so I"m thinking the phone calls will continue. They call every single morning at 8:30 am. Even if they could claim a mistake as stated above by 'ontrack', they certainly cannot now, can they? Not after I spoke with them today and told them, verbally this time, to NOT CALL anymore.

I have no intention of trying to get out of my debts, but this CA is a pain in the neck, and I refuse to let them hassle me, especially when they're breaking the law by calling me when I told them not to.

I wouldnt call anyone just yet... find out of she can settle for less.. it maybe possible if it is one lump payment but MAKE SURE YOU GET EVERY SINGLE DETAIL IN WRITING so they dont sell the balance to another JDB...

But it sounds like the judgement may have dropped off.. this will still be on your CR but if it is no longer at the courthouse you may not have to do a thing on it if they didnt renew it.. paying it wont remove it from your CR...

But dont be handing over wads of cash without thinking this through and reading up on this ... CHECK first to make sure the judgement is still valid.. then if it is and you want to work out payment.. CALL them and tell them you are willing to settle for 20% and work your way from there... you would be suprised what a creditor will take since they probably paid about 3 cents on the dollar for your debt

IF its not there anymore.. just wait for it to drop off ...because as I said paying it is not going to make it go off any faster...

In some ways it's easier to get rid of paid collections (not paid OC's), because if it's paid the CA doesn't want to spend any time or money on it. Even the stubborn ones, who ignore your disputes and DV's, will fold after recieving an ITS letter and delete it rather than waste resources to defend a tradeline for an old paid account that does them no good anymore.
It's all about money. If it will cost them less to simply mark their system to delete that tradeline at the next CRA update than to fight you to keep it on there, they'll do it.
Now, unpaid collections are a different story. They have a monetary impetus to keep that tradeline going.

I've been successful doing the process of:
1. Dispute with CA.
2. At the same time Dispute with CRA.
3. If nothing happens, and tradeline stays after 30 days, send ITS to CA. Even if it's completely unfounded. You don't plan on really suing. Hell, send a second one if it isn't gone after another 30 days. Won't hurt you any. I have yet to have a CA bother fighting after the ITS was sent. They have always folded and deleted.
optional and untested theory:
4. If the ITS still hasn't worked, actually file a suit. When they get the summons, I bet they'll contact you to work it out immediately. It is of no benefit to them to go to court for it. They'll simply lose money, even if they win. Then you can drop the suit before the actual court date. You'll lose some money in filing fees I imagine, but its a means to your goal.

OK, the attorney for the defendants contacted me and asked what it would take to settle. I offered dismissal with prejudice for $5K.

They counter offered with $1K. He said that since there is no debt, this is pure money in my pocket. I pointed out that this suit had nothing to do with the existance or nonexistance of a debt, that this was about his client's behavior in collecting it.

I told them no, I would rather go to trial. This case cost me almost $1K in service and filing fees.

He asked what I would settle for, I told him $3K. Any lower, and we proceed to the trial. They will wind up paying him at least that much in attorney's fees, plus whatever I get in the award. I am already guaranteed at least $1K in service and court costs.

We will see, they have less than a week to file an answer.

Here's how I recently removed a paid collection:

1) Sent a dispute letter to the CA. This is the same as a DV letter, except I replaced "debt validation" with "dispute" in the letter.

2) Disputed the TL with all 3 CRA's. Came back as verified.

3) Sent the CA an ITS letter outlining their FCRA violations (also violated CALI state law). Gave them 7 days to remove the TL's and pay me.

4. Checked my CR's and all TL's are gone!

I still need to file the lawsuit to get my money.

Post I need help! Citi closed my CC account
Here is the story: Recently, Citi closed my CC account due to return check. I called them and they said my account could not be reopened again, and they told me it will show up on my Credit history. I am scared now, because my mom was planning to buy a house under my name next year.

I am wondering if any way to get this history off my Credit Report? I have several late payments before as I remember, is it possible to erase that from my credit report as well?

Please help! Thank you so much!!!

I guess my question is should I contest things, late payments, etc I know to be true or is that a waste of time.

A Low Life Deadbeat From Creditnet Message Board

Judgment of $50k
I've been so stressed out and it's not even funny. it was a bad business venture and now i just got a letter from the bank's lawyer stating a judgment in the amount of $50k was entered against me. It was an UNSECURE line of credit that was used to purchase property and to fix them up. We went about things the wrong way and ended up losing a lot of money. Anyways, the letter states the sheriff MAY come after my money and other properties to satisty the judgment.

I dont owe anything and I am currently living with my family. I dont need someone knocking on my door harassing my family taking stuff out by the boxes! I'm so nervous I dont even know what to do. My car is in my dad's name and the house is in their name. I currently live in Pennsylvania so the good thing is they can't garnish my wages. I just got a new job and I'm moving in a month so I just want to be able to put everything behind me.

Does anyone know what MIGHT happen? They'll never see the money again and I sure as hell don't have any money in my bank. Can they go after my bank accounts?
